Idaho Bulletin 450-6-5

SUBJECT:  TCH - Federal, State and local laws and regulations

TO:  All Employees, NRCS, Idaho

Purpose.  To provide guidance on supporting documentation associated with permits and letters of exemption

Expiration Date.  December 31, 2006

Recent Field Office Quality Assurance Reviews (QARs) have indicated the need for clarification of procedures related to maintaining copies of required federal, state and local permits associated with the installation of conservation practices.

This is a reminder that General Manual, Section 450, Part 405 - Amendment ID 21 clearly states that “Landowners must furnish NRCS with a copy of applicable water rights, permits or letters of exemption before final designs, drawings and specifications are prepared. Copies of applicable permits or letters of exemption will be filed with the supporting data for the design. All correspondence between NRCS and the landowner or local agencies concerning permits will be sent under the signature of the district conservationist”.

All Field Offices should review the above referenced 450-GM, Part 405, Amendment ID 21, dated March 2004, and follow all guidance related to documentation requirements associated with federal, state and local permits.
