PER - No FEAR Act
TO: All Employees,
NRCS, Idaho
Purpose. To distribute
“Prohibited Personnel Practices” and Whistleblowing” posters to all offices and
request supervisors to complete required training regarding their
responsibilities under the whistleblower protection provisions of Title 5.

- Action required by all offices: Display

- Action required by August 15, 2005 by all
managers and supervisors: Review whistleblower protection provisions of
Title 5 slide presentation and notify Human Resources Officer of completion
Federal employees have the right to be free from retaliation for exercising
their rights under any of the Federal Antidiscrimination Laws or Whistleblower
Protection Laws. Congress has mandated that federal workers and managers be
made aware of their rights and responsibilities by enacting the “Notification
and Federal Employee Antidiscrimination and Retaliation Act of 2002,” known as
the No FEAR Act. The Act requires NRCS to inform employees and applicants of
the rights and protections available to them under Federal antidiscrimination,
whistleblower protection and retaliation laws.
- To comply with the Act, all offices must display two posters (enclosed)
containing information about antidiscrimination laws, the laws regarding
prohibited personnel practices (PPP), as well as information regarding the
process for making confidential disclosures to the Office of Special Counsel
(OCS) under the Whistleblower Protection Act (WPS). Please display the
posters in a prominent place, which can be seen by all individuals visiting
the office.
- There is also a requirement for agencies to train all managers and
supervisors regarding their responsibilities under the whistleblower
protection provisions of Title 5. A slide presentation has been developed
to fulfill this requirement. This 36-slide presentation can be accessed at
http://www.osc.gov/library.htm#2302c. All managers and supervisors must
complete this training task by August 15, 2005. Upon completion, notify
Bobbi Teigen, Human Resources Officer, by email at
Barbara.Teigen@id.usda.gov or by telephone at 208-378-5712.
The Office of Special Counsel (OSC) requires each state to submit a report
documenting completion of the two action items required in this bulletin. Thank
